Privacy Policy

My Boat Brain is operated by My Boat Brain, a corporation incorporated in the Province of British Columbia, Canada ("My Boat Brain", "we", "us", or "our"). This Privacy Policy explains how we collect, use, disclose, and safeguard your personal information when you use myboatbrain.com and the My Boat Brain mobile-progressive web application (collectively, the "Service").

We are subject to the Personal Information Protection Act (British Columbia) ("PIPA") and, where applicable, the federal Personal Information Protection and Electronic Documents Act("PIPEDA"). By using the Service you consent to the practices described in this policy.

1. Information We Collect

Account information

When you register we collect your name, email address, and a hashed password through our authentication provider (Clerk). If you sign up via Google or Apple, we receive the name and email associated with that account.

Vessel and operational data

All boat data you enter -- vessel profiles, maintenance records, trip logs, fuel fills, expenses, checklists, crew information, and logbook entries -- is stored in our cloud database and synced to your device for offline use.

Payment information

Subscription and gift-subscription payments are processed by Stripe. We do not store your card number or CVV. We retain the Stripe customer ID, subscription status, and transaction history needed to manage your account.

Notification preferences and contact details

If you enable email or SMS notifications we collect your email address (already on file) and optionally your mobile phone number. Phone numbers are stored in encrypted form and used solely to deliver maintenance reminders.

Usage data

We collect standard server logs including IP addresses, browser type, pages visited, and feature interactions. This data is used for security, debugging, and aggregate product analytics. We do not sell or rent usage data to third parties.

AI chat inputs

When you use the in-app AI assistant, your messages and relevant vessel context are sent to Anthropic's Claude API to generate a response. Inputs are processed in real time and are not used to train AI models. See Section 5 for Anthropic's data practices.

2. How We Use Your Information

We use personal information to:

  • Create and maintain your account
  • Provide, operate, and improve the Service
  • Send maintenance reminders, account notices, and transactional emails
  • Process payments and prevent fraud
  • Respond to support requests
  • Comply with legal obligations
  • Produce aggregate, anonymised analytics about how the Service is used

We will not use your personal information for purposes that a reasonable person would consider inappropriate given the context in which it was collected.

3. Disclosure of Your Information

We do not sell your personal information. We may share it in the following limited circumstances:

  • Service providers. We engage the third-party providers listed in Section 5 to operate the Service. Each provider receives only the data necessary for its function and is contractually bound to protect it.
  • Legal requirements. We may disclose information when required by law, court order, or governmental authority, or when we believe disclosure is necessary to protect our rights or the safety of others.
  • Business transfers. If My Boat Brain is acquired or merges with another entity, your information may be transferred as part of that transaction. We will notify you before your information becomes subject to a materially different privacy policy.
  • With your consent. We may share information for any other purpose with your prior consent.

4. Data Retention

We retain your account and vessel data for as long as your account is active. If you delete your account, we will delete or anonymise your personal information within 90 days, except where we are required by law to retain it longer (for example, billing records required for tax purposes may be kept for seven years).

These providers may transfer and process data outside Canada. By using the Service you consent to such transfers, which are governed by the contractual safeguards each provider maintains (including standard contractual clauses where applicable).

6. Cookies and Local Storage

The Service uses browser cookies and localStorage to maintain your session and store offline data (your vessel records, preferences, and offline-sync cache). These are functional and cannot be disabled without breaking core features. We do not use third-party advertising cookies.

7. Your Rights

Under PIPA and PIPEDA you have the right to:

  • Know what personal information we hold about you
  • Access a copy of your personal information
  • Correct inaccurate information
  • Withdraw consent for non-essential uses (with the understanding that doing so may limit Service functionality)
  • Request deletion of your account and personal data

8. Security

We implement reasonable administrative, technical, and physical safeguards to protect your personal information, including TLS encryption in transit, encrypted storage at rest, and access controls limiting who can view production data. No security measure is perfect -- in the event of a breach we will notify affected users as required by law.

9. Children

The Service is not directed at children under the age of 13. We do not knowingly collect personal information from children. If you believe a child has provided us with personal information, please contact us and we will delete it promptly.

10. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the revised policy with an updated effective date and, for material changes, notify you by email. Continued use of the Service after the effective date constitutes acceptance of the updated policy.
